This is the opportunity for which we have been long praying, and one which, if neglected now, may never come again. If we let our cause be lost now, we serve notice . on our Legislature that our people are opposed to State prohibition; to win by a small majority will mean the indefinite continuance of the fight; to win overwhelmingly will settle the question once for all. A Hard Let us not be deceived- by the soothing assurance that Fight victory will be easily won. On the contrary we need strenuous efforts of every temperance man and woman, a thorough organization in every township, and every vote that can be cast. The liquor manufacturers and dealers of the whole country are pour ing money into our State and flooding it with pernicious literature filled with specious falsehoods. And some of our own newspapers and politicians are using all their influence to prejudice the people against prohibition. The Proposed This bill was carefully prepared by the Prohibition Law wisest temperance men in the State, and is advocated by hosts of great men of all parties, like Gov. Glenn, ex-Govs. Jarvis and Aycock,- Senator Simmons, Judges Pritchard and Shaw, A. M. Scales, H. A. London, Josephus Daniels, G. W. Watts, H. A. Page, F. R. McNinch, J. H. Pou, N. B.Broughton, W. H. Sprunt, E. T. Cansler, Cameron Morrison, F. S. 'Blair, Settle Dockery, E. F. Aydlett and J. W. Bailey. . What This Law It will abolish every licensed whiskey and Will Do brandy distillery and every saloon and dis pensary in the State; will prevent a few towns from debauching other communities and partially nullifying their prohibition laws; will stop the selling of wine except at the place of manufacture and outside the State and for sacramental purposes; will stop the sale of all intoxicating chemical mixtures except necessary drugs and essences; and will strictly regulate the sale of intoxicating liquors in drug stores. Organizes Work While we do not presume to dictate to you Pray, Vote how you shall vote, we as your pastors do appeal to you to vote according to your religious and moral convic tions for the cause of good morals and civic righteousness. Let the good men of every township get together, organize for this campaign, appoint a strong executive committee, arrange for mass meetings and secure good speakers, write to the Anti-Saloon League, Raleigh, N. That it shall be un lawful for any person or persons, firm or corporation to manufacture or in any manner make, or sell, or otherwise dispose of, for gain, any spirituous, vinous, fermented or malt liquors or intoxicating bitters within the State of Nor th Carolina: Provided, this act shall not be con strued to forbid the sale of such spirituous, vinous, fermented or malt liquors or intoxicating bitters by a legalized medical depository, or by any licensed and registered pharmacist, for sickness, upon the written prescription of a regular li censed' and actively practicing phy sician or surgeon having the person for whom such prescription is made under his charge, which said pre scription shall specify the amount of spirits required: Provided further, that wines and ciders may be manu factured or made from grapes, ber ries or fruits, and wine sold at the place of manufacture only, and only in sealed or crated packages con taining not less than two and a half gallons per package, but no wine, when sold, shall be drunk upon the premises where sold, nor shall the package containing thes ame be open ed on said premises: and, Provid ed further, that nothing herein con tained shall be construed to prevent the sale of cider, in any quantity, by the manufacturer from fruit grown on his lands within the State of North Carolina. Section 2. That all liquors or mixtures thereof, by whatever name called, that will produce intoxica tion shall be construed and held to be intoxicating liquors within the meaning of this act: Provided, that medicinal preparations manufactured in ac cordance with formulas prescribed by the United States Pharmacopoe ia and National Formulary which contains no more alchol than is neo essary to extract the medicinal prop erties of the drugs contained in such preparations, and no mora al cohol than is necessary to hold the medicinal agents in solution, and which are manufactured and sold aa medicines and not as beverages, shall not be held or construed to be or to come within the meaning or provisions of this act. Skc 8 That any physician or surgeon who shall make any pre scription (except in case of sick ness) for the purpose of aiding or abetting any person or persons who are not bona fide under his charge to purchase any intoxicating liquors contrary to the provisions of this act, and any licensed and registered pharmacist who shall sell or other wise dispose of, for gain, any spirit nous, vinous, fermented or malt liq uors or Intoxicating bitters with out the written prescription of a legally qualified physician or sur geon, or who shall duplicate the prescription of a physician or sur geon for intoxicating liquors lor any persons not bona fide under such physician's or surgeon's charge without the written direction of the physician or surgeon who gave the same, shall be guilty of a misde meanor, and upon conviction shall be fined or imprisoned, or both, in the discretion of the court, tor each and every offenae, and all licensed and registered pharmacists selling intoxi cating liquors by prescription as aforesaid shall keep a record there of, which shall bear the true dates of the sals, the names of all parsons to whom sales are made, the name of physicians or surgeons upon wooes prescriptions th sales were made, which said record shall be subject at all times to lbs Inspec tion of the solicitor of the district, the sheriff and other peace officers of th county, th mayor and polios officers of the city or town in which said licensed and registered pharma cist's business is Iocs tad, and all other persons; snd any lioeoaed snd regis tered pharmacist failing to ksep the record aforesaid, or refusing to per mit th examination of such records by th ftStcers named, or other par cos, shall be guilty of a misde meanor, and upon conviction to bs Coed or lmpriaooad, or both to the diacrrtion of th court. ggc 4 Tbs place whore delivery of say intoxicating liquors la mad ia lb Stat of North Carolina shall bs ooostrnced and bald to bs the plaos of sal thereof, and say sta tion or other place within said Btat to which any parson shall ship or convey any intoxicating 1 iquors for the purpose of delivering or carry ing the same to a purchaser shall be construed to be the place of sale: Provided, that nothing in this act shall be construed to prevent the delivery of any intoxicating liquors to aDy licenced and registered phar maciflt in sufficient quantities for medical purposes only. Sec. 5. Nothing in this act shall be construed as making it unlawful to sell to any minister of religion or jother officer of a church wine to be used for religious or sacra mental purposes. Sec 6. That nothing in this act shall be construed to prevent the county commissioners ,or governing body of any city or town from pro hibiting the sale of spirituous, vin ous, fermented or malt liquoro or intoxicating bitters by any licensed and registered pharmacist in their respective counties, cities or towns Provided further, that said county comxisBioners or governing body of any city or town may levy a spe cial privilege tax upon any licensed pharmacist licensed to sell spiritu ous, vinous, or malt liquors. Sec. 7. That all laws or parts of laws in conflict with this act be and the same are hereby, to the ex tent of such conflict, repealed: Pro vided, however, that nothing in this act shall operate to repeal any of the local or special acts of the General Assembly of North Carolina prohib iting the manuiacture or sale or other disposition of any of the liq uors mentioned in this act; but all such acts shall continue in full force and effect and in concurence here with; and indictment or presecu tion may be had either under thin act or any special or local act relet ing to the same subject: Provided, that if the provisions of sections one to nine (inclusive) of this act shall fail to go into effect on the first day of January, one thousand nine hun dred and nine, because of the fail ure of a majority of the votes cast in the election hereinafter provided for to be "Against the Manufacture and Sale of Intoxicating Liquors," then this act shall not be construed as a repeal of any laws under which prohibition or a dispensary has been established; nor shall it have the ef fect of restoring license where pro hibition or a dispensary now ob tains. Sro. 8. Any person violatingjany of the provisions of this act shall be guilty of misdemeanor. Bfo. 9. That the foregoing pro visions of this act shall go into effect on the first of J anuary, In the year of our Lord one thousand nine hun dred and nine, if a majority of the votes cast, a the election herein after provided for shall be "Against tbs Manufacture and Sale of Intoxi cating Liquors," Sec 10. That on the last Tues day in May in the year of our Lord one thousand nine hundred and eight, an election shall be held in the several election precincts in each county of the State of North Caroli na to determine whether the provis ions of sections one to nine (inclusive) o( this act shall become effective. Said election shall be held and conducted under the same rules and regulations and in the same manner as elections for State officers; and unless otherwise pro vided in this act, the general laws regulating elections, as set forth in chapter ninety of the He visa of one thousand nins hundred and five of North Carolina, and the amend ments thereto, shall be applicable to said election. At said election every person qualified to vote for mem bers of tbs General Assembly shall bars th right to vote. At each election precinct there shall bs s ballot box provided for tbs purpose of said election, which shall bs la beled in plain Roman letters, "For or Against th Manufactur and Sal of Intoxicating Liquors." In all other respects said ballot box shall be in confrom ity with th genera) law regulating lections, a act forth in chapter ninety of th Revise! of on thou sand nin hundred and firs of North Carolina and the amendment there to. The State Board ol Elections and the several county boards of elections are hereby authorized, empowered and directed to take all such actions as may be necessary to fully provide for the election to be held in accor dance with this act. The several county boards of elections shall meet in their respective counties, not later than the second day of April in the year ot our Lord one thousand nine hundred and eight, and arrange for the holding of said election, by selecting and appoint ing a registrar and two judges of election for each election precinct in their respective counties, the duties and powers of whom shall be in all respects as provided in the general election laws of the State, as ahove referred to. In making the appoint ments of judges of election the coun ty boards of elections shall, if possi ble, each appoint for each election precinct one competent person gen erally known to be in tavor of the manufacture and aale of intoxicating liquors in the State of North Carolina and one competent person generally known to be opposed to the manu facture and sale of intoxicating liquors in the State of North Caroli na. The several county boards of elections shall .nake publi cation of the namos of the registrars and judges of elec tion and serve notice upon them as required by the general election laws of the State. The compensation ol all officers engaged in the said elec tion shall be the same a is provided by law for similar service in case of general State elections. Black burn alleged that the car in which he rode from Greensboro to Wash ington, March 2, 1905, to attend the Roosevelt inauguration, was not properly heated and as a result the plaintiff suffered an attack of ill ness.
